 In 1998, EPA settled several lawsuits challenging the scientific validity of whole effluent toxicity test methods. EPA agreed to study the problem of WET test variability and issue new guidance manuals.

The Agency proposed new WET methods in September, 2001.  The rule will be finalized in late 2002.
